Right of withdrawal
According to the legislation in place since 13 June 2014, when concluding distance contracts for digital content which is not supplied on a tangible data storage medium, the consumer is generally entitled to withdraw from the contract within 14 days. This withdrawal period will start on the day of contract conclusion.
It will enable you to cancel orders with micro-concerto within 14 days. Your right of withdrawal will expire, however, as soon as you start downloading the micro-concerto files you have bought, as digital content cannot be returned.
Further details regarding exceptions from the right of withdrawal are set out in Article 16 (m) of the EU Consumer Rights Directive and its transposition in the German Civil Code.
Section 356 (5) of the German Civil Code (amended version) sets forth the following:
In the case of a contract for the supply of digital content that is not contained in a tangible medium, the right of revocation expires also if the entrepreneur began with the performance of the contract after the consumer
1. had expressly consented to the entrepreneur beginning with the performance of the contract prior to expiry of the revocation period, and
2. had acknowledged that by his consent, he would lose the right to revoke the contract upon the performance of the contract having commenced.
To exercise the right of withdrawal, you must inform micro-concerto (Gero Stöver, Rathenaustraße 22, D-53919 Weilerswist, Germany, fon +49 (0)2254-846363), e-mail email@example.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the model withdrawal form available at the bottom of this website, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from a contract concluded with micro-concerto, we shall reimburse to you all payments already made by you without undue delay and in any event not later than 14 days from the day on which micro-concerto is informed about your decision to withdraw from the respective contract. Micro-concerto will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of such reimbursement.
